Central Government planning legislation requires that applications for development are carried out in accordance with the provisions of the development plan unless material considerations indicate otherwise.

The operative development plan for the site in question is comprised of the following documents, and the planning application will be assessed against the policies contained within them, together with any other relevant matters such as the National Planning Policy Framework (published in July 2021):

  • The Warwick District Local Plan was adopted in September 2017 and covers the period 2011-2029.

The Warwick District Council Local Plan provides the spatial strategy and strategic policies for the district to deliver development in the period 2011-2019.

The application site falls within a wider site (H18: Former Aylesbury House, Hockley Heath) allocated for housing in the Local Plan under Policy DS11. The supporting text to Policy DS11 at Paragraph 2.44 states the site has potential for some redevelopment and infilling around the original Aylesbury House. It should be noted that Aylesbury House is not included in this allocation.

The potential for further residential development has been created with the Cameron Homes site coming forth providing 18 residential units. The Cameron Homes site in addition to this site has the potential to deliver up to 49 dwellings. This is greater than the recommended 20 units as stated within policy DS11 but it should be noted that this is not meant to be a cap.  As such, development upon this vacant greenfield land would make best use of the land available within a highly sustainable area.
